Terms of Use.
These Terms govern access to and use of the Auction Foundry website and the materials Auction Foundry provides through it. In these Terms, “Auction Foundry,” “we,” and “us” mean Auction Foundry LLC, a Michigan limited liability company.
Version 2.1, effective October 9, 2026.
1. Acceptance, scope, and eligibility
These Terms govern your access to and use of this website and its documentation, calculators, and other website-provided materials (the “Site”). TradingView and other third-party services are governed by their own terms. Published code is governed by the license identified in its file header or publication listing. By using the Site, you agree to these Terms. If you do not agree, do not use the Site. You must be at least 18 years old, have reached the age of legal majority where you live, and be legally able to enter into this agreement.
Nothing on this Site is for sale. Auction Foundry does not operate a checkout, take payments, offer a subscription or a trial, or hold payment credentials. Everything published is available at no cost, as described in section 7. No part of these Terms is an offer to sell anything, and these Terms describe no product, tier, trial, or subscription that you can buy.
Documents that form part of these Terms. The Risk Disclosure supplements these Terms. The Privacy Notice separately explains our data practices; using the Site does not give consent to optional data processing. Each document identifies its effective date. Applicable law and rights that cannot be waived take priority over these documents.
2. Educational purpose and relationship
The Site provides general, impersonal educational charting information and planning tools. Auction Foundry is not registered with the U.S. Securities and Exchange Commission as an investment adviser, is not registered with the Commodity Futures Trading Commission as a commodity trading advisor, and is not a member of the National Futures Association. We do not provide individualized investment, financial, legal, tax, or other professional advice. Nothing on the Site is a recommendation, offer, solicitation, or instruction to buy, sell, hold, or trade an instrument. We do not execute orders, access brokerage accounts, manage assets, or accept trading authority. Use of the Site does not create an advisory, brokerage, fiduciary, or professional relationship. Read the Risk Disclosure before using the Site.
3. Market and calculation risk
Trading and investing can result in loss of some or all capital. Margin, futures, options, leveraged products, gaps, liquidity constraints, liquidation rules, and execution failures may cause losses beyond a modeled stop or initial deposit. Calculator outputs are estimates based on entered assumptions and do not reflect actual orders, fills, taxes, or every fee. No indicator, alert, chart, example, estimate, or communication guarantees an outcome. Stops may execute at a different price or not execute. Independently confirm instrument specifications, prices, market data, fees, margin rules, and order behavior with the relevant broker, exchange, or data provider.
4. Third-party services
The Site links to TradingView and other third-party services for convenience. Auction Foundry does not control their availability, market data, moderation, alerts, account requirements, security, privacy, or terms. Your use of a third-party service is governed by that service’s terms and privacy notice. A link does not imply endorsement, sponsorship, or affiliation. Third-party names and marks belong to their respective owners.
TradingView specifically. Auction Foundry publishes its scripts to TradingView as an ordinary community author, on the same public terms available to any TradingView user. Auction Foundry is independent of, and is not affiliated with, endorsed by, sponsored by, or a partner, agent, reseller, or authorised representative of TradingView, Inc. “TradingView” is a trademark of TradingView, Inc. and is used on this Site only to identify the platform the scripts are published on. Access to a script depends on your own TradingView account; if that account is closed, suspended, renamed, or otherwise unavailable, contact TradingView about the account issue. We can help with our own script documentation but cannot restore a TradingView account.
5. Website-content license
Subject to these Terms, Auction Foundry grants you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Site for lawful personal or internal purposes. Except as permitted by law or an applicable software license, you may not reproduce, sell, sublicense, remove proprietary notices from, or commercially exploit protected Site content.
6. Script licenses
Published Pine code is governed by the license stated in the applicable file header or TradingView listing. These Terms do not limit rights granted by that license. When code is reused or republished through TradingView, TradingView’s publishing and code-reuse rules also apply. Website text, branding, images, and documentation do not inherit the license that applies to related Pine code.
7. How you get the scripts, and what they cost
Everything published is free. Our currently published indicators are available through TradingView at no charge from Auction Foundry, subject to TradingView’s own account requirements and limits. Every manual, the research library, and the risk planner are readable on this Site at no cost. No Auction Foundry account, email address, payment method or installation from this Site is required. Free invite-only scripts require an access grant from the author after a private TradingView message; follow the instructions in the applicable listing.
Auction Foundry takes no payments. There is no checkout on this Site, no purchase price is offered, and no subscription, trial, or paid tier is offered or sold. Auction Foundry does not hold, process, or store card numbers, bank details, or billing addresses, and no third-party payment platform is engaged for this Site. There is therefore no charge to reverse, no renewal to stop, and no subscription to cancel. If you believe you have been charged by anyone claiming to be Auction Foundry, that charge did not originate here — tell us through the Feedback and Support page and contact your bank or card issuer.
Access is not guaranteed to last. Availability depends on TradingView continuing to host the publication and on your own TradingView account. A script may be updated, renamed, or withdrawn. Invite-only access is granted per-user and revocable.
8. Acceptable use
You may not use the Site unlawfully; interfere with its security or operation; introduce malicious code; attempt unauthorized access; impersonate another person; infringe third-party rights; attempt to bypass access restrictions on protected script logic, except as permitted by law or the applicable software license; or use the Site to facilitate fraud, market manipulation, or unauthorized access to financial accounts.
9. Feedback
If you submit suggestions or feedback, you authorize Auction Foundry to use them to evaluate and improve its products without an obligation to compensate you. Do not submit confidential information, third-party proprietary material, brokerage credentials, or requests for individualized trading advice.
10. Testimonials and results
The Site currently publishes no testimonials, reviews, or user results. Where Auction Foundry publishes a testimonial, review, or user comment, it reflects that person’s experience and is not a guarantee, promise, or typical result. Auction Foundry does not have access to user brokerage accounts or statements and does not verify claimed trading results. Material connections, including any compensation, free or discounted access, or other incentive provided in exchange for a statement, are disclosed alongside it. Charts and historical examples illustrate how tools behave; they do not represent a trading track record. Any simulated or backtested performance is hypothetical and does not establish what a user would have earned or will earn.
11. Privacy
The Privacy Notice explains how information is handled when you use the Site. Review it before submitting feedback or sharing a plan link.
12. Availability and corrections
Auction Foundry may modify, suspend, or discontinue Site features. We do not guarantee uninterrupted operation, continued third-party compatibility, or that data, alerts, documentation, or calculations will always be timely, complete, accurate, secure, or error-free. Nor do we guarantee that a third-party platform will continue to host or provide access to a listing. Independently confirm information before acting.
13. Intellectual property
Auction Foundry and its licensors retain their rights in the Site, branding, protected scripts, documentation, and content, subject to the code-license rights described above. “TradingView” is a trademark of TradingView, Inc. Auction Foundry is independent of and not affiliated with TradingView, Inc.
14. Copyright complaints
Auction Foundry respects copyright. If you believe material on the Site infringes a copyright you own or control, email support@auction-foundry.io with your physical or electronic signature, identifying the work claimed to be infringed, identifying the material and its location with enough detail to locate it, your contact details, a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law, and a statement, under penalty of perjury, that the information is accurate and you are authorized to act. Auction Foundry may remove or disable material claimed to be infringing and may terminate access for repeat infringers.
15. Export controls and sanctions
You represent that you are not located in, ordinarily resident in, or acting on behalf of a person or jurisdiction subject to comprehensive sanctions administered by the United States or another applicable authority, and that you are not on a restricted or denied-party list. You may not access the Site in violation of applicable export-control or sanctions laws.
16. Electronic communications
If you write to Auction Foundry, you consent to receive its reply electronically, at the email address you write from or one you provide. We will provide notices in the form required by applicable law; an email reply does not waive any formal notice or consent requirement. Auction Foundry does not operate a mailing list and sends no marketing email.
17. Warranty disclaimer
To the fullest extent permitted by law, the Site is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, security, or availability. We do not warrant that the Site will meet your requirements or be free from harmful components. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
18. Limitation of liability
To the fullest extent permitted by law, Auction Foundry and its owners, officers, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for trading losses, lost profits, lost data, or business interruption arising from or related to the Site. These limitations apply regardless of legal theory and even if a party was advised that damages were possible. They do not exclude liability for fraud, intentional misconduct, gross negligence, or any liability or consumer right that cannot lawfully be excluded or limited.
19. Responsibility for misuse
You are responsible for your own unlawful conduct and infringement of others’ rights. Responsibility for a claim, damages, or legal costs is determined under applicable law. These Terms do not require you to defend or reimburse Auction Foundry for its own misconduct.
20. Restricted access and survival
Auction Foundry may restrict access to the Site for a material violation of these Terms or conduct that threatens the Site or others. Provisions concerning intellectual property, disclaimers, liability, dispute resolution, and general terms survive termination where their nature requires it.
21. Governing law and dispute resolution
These Terms are governed by the laws of the State of Michigan, subject to any mandatory protections provided by the law that applies to you.
If a problem arises, email support@auction-foundry.io with a description and the resolution you are seeking, or write to the address in section 23. You may contact us to seek an informal resolution, but doing so is not a condition of bringing a claim and does not shorten or extend any legal deadline.
These Terms do not require arbitration, waive a jury trial or participation in a class action, or shorten the time allowed by law to bring a claim. A dispute may be brought in a court with jurisdiction under applicable law, including an appropriate small-claims court.
Nothing in these Terms removes rights or remedies that cannot lawfully be waived, including applicable rights under the Michigan Consumer Protection Act. This version applies prospectively; it does not rewrite earlier events or resolve the effect of an earlier version on an existing dispute.
22. Changes to these Terms
We may update these Terms prospectively. The effective date identifies the current version. For material changes, we will provide notice reasonably suited to the Site where required or reasonably practicable. Changes take effect on the stated effective date. Where applicable law requires notice or affirmative agreement, we will obtain it before applying the change. Changes do not apply retroactively. If you do not agree, stop using the Site.
23. General terms and questions
If any provision is found unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. Neither party is liable for a failure to perform caused by events beyond its reasonable control, including outages at a third-party platform, exchange, or data provider. You may not assign these Terms without our consent; Auction Foundry may assign them as part of a merger, reorganization, or transfer of the Site. Headings are for convenience only. These Terms, together with the Risk Disclosure referenced in section 1, are the entire agreement between you and Auction Foundry concerning use of the Site, and they supersede any earlier version or discussion. They create rights only between you and Auction Foundry, with no third-party beneficiaries. Legal notices and questions may be sent directly to support@auction-foundry.io. For product suggestions or defects, use the Feedback and Support page. Do not include brokerage credentials, account numbers, or sensitive financial records.
